This agreement (the “Waiver”) hereby entered into between Trail Roots, LLC, any related companies, and the owners, officers, directors, affiliates, employees, agents, and assigns of any of them (“we”, “us”, “our”, “ours”, or “ourselves”) and the person subscribing or participating and their heirs or legal representatives ("you", “your”, “yours”, or “yourself”).
We offer a variety of exercise and fitness programs, such as: running classes, personal training, running races, and more. You understand that it is your responsibility to consult with a physician prior to and regarding your participation with us. You represent and warrant that you are physically fit and you have no medical condition that would prevent your participation with us.
In consideration of being permitted to participate with us, you agree to assume full responsibility for any risks, injuries or damages, known or unknown, which you might incur as a result of participating with us.
You hereby voluntarily release, discharge, waive and relinquish any and all claims or causes of action for personal injury, property damage, or wrongful death against us, which may arise out of or in connection with your participation with us as a result of our negligence.
For valuable consideration received, you agree that we may use and publish photos which include you or your likeness, such as for advertising or any other purpose or in any matter or medium without your inspection or approval.
We may, at any time, and at our sole discretion, modify this Waiver. Any such modification will be effective one week after public posting on this web page. Your continued participation following any such modification constitutes your acceptance of the modified Waiver.
You are welcome to cancel your subscription at any time through your online portal. Upon cancellation, we will cease charging your account. You are allowed to use the remaining services you have prepaid. It is not necessary to wait until the last day of the month to cancel your subscription.
If you have any problems canceling your subscription, please contact us and we will respond within 2 business days.
We do not offer refunds, returns, exchanges, or credit on products or services., such as trips, coaching services, prepaid plans, and all other purchases.
We do not accept returns or exchanges unless the item you purchased is defective at our sole discretion. If you receive a defective item, please contact us with details of the product and the defect. We will exchange sizes on shirts, but you are responsible for the shipping costs.
We do not offer refunds for any coaching services. We don't offer refunds on discounted multi - month training packages. If you need to pause your services, please contact us and we will pause at our sole discretion. We will allow you to finish out your package within 6 months of pausing your account.
